HC directs central govt to comply with order


The High Court of Bombay at Goa in a case related to setting up of State Organ and Tissue Transplant Organisation (SOTTO) has directed the central government to comply with the order dated December 6, 2018 and to communicate to the state government whether, any further steps are to be taken by the state government or not so as to comply with the order of the court.

The High Court, by order dated December 6, 2018, had directed the state government and the Union of Ministry of Health to immediately set up a state organ and tissue transplant organisation within six months as enjoined by the Transplantation of Human Organ and Tissues Rules, 2014. The High Court said that perusal of the records indicate that the central government has not responded to the reply of the state government to the requisition made by central government to letter dated November 6, 2018 for last more than three months.  Wilbur Menezes is the counsel for the petitioner Mango Foundation. It was submitted by the counsel for the state government that in so far as the state government is concerned, all requisite steps are already taken by the government for complying with the order dated December 2018. It is for the central government now to issue notification in terms of Rule 31(2) of the Transplantation of Human Organs and Tissues Rules, 2014. NT
